These Terms of service create a legally binding agreement between you, whether as an individual or on behalf of an entity ("you", "your") and BBOX LP ("we", "us", or "our"), regarding your use of the myapoteka.com website, as well as any other media forms, channels, mobile websites, or applications associated, linked, or connected to it (collectively, the "Site"). By accessing the Site, you acknowledge that you have read, understood, and agreed to comply with all of these Terms of Service. If you do not agree with any part of these Terms of Service, you are explicitly prohibited from using the Site, and you must cease use immediately.

AGREEMENT TO TERMS

Supplemental terms and conditions or documents posted on the Site are incorporated herein by reference. We may modify these Terms of Service at any time and for any reason at our sole discretion. We will update the "Last updated" date to notify you of any changes. It is your responsibility to review these Terms of Service periodically. By continuing to use the Site after revised Terms of Service are posted, you are deemed to have accepted and be bound by the changes.

SERVICES PROVIDED

We offer Intermediary services to assist in the search, procurement, and processing of medicine procurement requests from Germany. The medicines are supplied by registered German pharmacies operating under the license of DIMDI Deutschland-Europa-Welt-Web-Eintragung.

It is important to note that BBOX LP is not a pharmaceutical company. Instead, it acts as an intermediary between healthcare providers and pharmacies, providing services for locating, purchasing, and delivering medications. Unlike pharmacies, BBOX LP does not function as a pharmacy itself.

It is important to note that all the medicines we offer do not require a prescription and can be freely dispensed in Germany.

We undertake, on your behalf, to perform the following actions as part of the Services:

- Presenting goods from German manufacturers. This could involve providing information, images, descriptions, or other forms of presentation to familiarize you with the goods available.

- Purchasing from German pharmaceutical industries and German pharmacies upon your request. This could involve placing orders, coordinating payment and delivery, and ensuring that the products are acquired and delivered to you.

In summary, we are offering a service where we will present goods from German manufacturers and facilitate the purchase of products from German pharmaceutical industries and pharmacies, all on your behalf.

In consideration of our services, we deduct a commission from you, which is calculated separately on the website and not included in the cost of delivery.

You acknowledge and agree that we have the right to engage third parties to fulfill our obligations under this Agreement. The following third parties may provide services on our behalf: myCARE e.K (Germany), Apotheke BV (Netherlands), and Bad-Apotheke Heinz-Peter Fichter e.K (Germany).

DELIVERY

We strive to provide accurate delivery dates on the Site. However, we are not liable for any non-compliance with the specified delivery time, as delivery dates are estimates and cannot be guaranteed.

Please note that since all products are shipped from Germany to your country, you may be subject to customs duties based on your country's laws and customs tariffs. While we make efforts to provide information on such restrictions, we cannot guarantee its accuracy and relevance. You are responsible for paying any customs duties in your country.

In the event of a lost parcel, we will refund the full amount of the order, including the cost of products and delivery. However, you must provide necessary evidence to prove that the package was not delivered. Processing and refund times may take up to 15 business days.

If you have paid for products that were not delivered, we will refund the cost of those products. Again, you must provide necessary evidence to prove that the paid goods were not included in the delivered order. Processing and refund times may take up to 15 business days.

RETURN

You have the right to return a product in accordance with the German consumer protection law, specifically the Law for the Implementation of the Consumer's Rights Directive (Gesetz zur Umsetzung der Verbraucherrechterichtlinie und zur Änderung des Gesetzes zur Regelung der Wohnungsvermittlung - VRRLUmsG). If you wish to return a product, you are responsible for the delivery costs to the warehouse in Germany and can choose any delivery service.

In the case of receiving a defective or incorrect item, we will refund the cost of the item and the delivery costs associated with that item, deducting the total delivery cost. Refunds will be issued after either the destruction of the product or its delivery to the German warehouse at our expense. Please contact us first for further instructions. Processing and refund times may take up to 15 business days.

PRODUCTS

We strive to provide accurate and detailed information about the colors, features, specifications, and details of the products displayed on the site. However, we cannot guarantee that the colors, features, specifications, and details of the products will be completely accurate, reliable, current, or free from errors. Please note that the actual colors and details of the products may differ from what you see on your electronic display. Availability of products is subject to change, and we cannot guarantee that all items will be in stock. We reserve the right to discontinue any products at any time for any reason. Prices for all products are subject to change.

PURCHASES AND PAYMENT

Please ensure that your purchase and account information provided for transactions on the Site is current, complete, and accurate. Keep your account and payment information, including email address, payment method, and payment card expiration date, up to date so that we can process your transactions and contact you when necessary. Prices may change at any time. You are responsible for paying the current charges for your purchases, including applicable delivery fees, and by placing your order, you authorize us to charge your selected payment provider for the relevant amounts. We reserve the right to correct any pricing errors or mistakes, even after payment has been requested or received. We reserve the right to reject any orders placed through the Site. We may, at our sole discretion, limit or cancel the quantity of items purchased per person, household, or order. These restrictions may apply to orders placed under the same customer account, payment method, or billing/shipping address. We reserve the right to limit or prohibit orders that, in our judgment, appear to be placed by dealers, resellers, or distributors.

INTELLECTUAL PROPERTY RIGHTS

CONTRIBUTION LICENSE

These terms are governed by the laws of Ireland. BBOX LP and you agree that any dispute arising from these terms shall be exclusively resolved by the courts of Ireland.

DISPUTE RESOLUTION

Parties will attempt informal negotiations for at least 15 days before initiating arbitration. Any dispute shall be resolved by the International Commercial Arbitration Court under the European Arbitration Chamber, with Ireland as the seat of arbitration. The arbitration will be limited to individual disputes, excluding intellectual property rights, theft, piracy, invasion of privacy, unauthorized use, and claims for injunctive relief.

CORRECTIONS

We strive to provide accurate and up-to-date information on the Site, but there may be instances of typographical errors, inaccuracies, or omissions. This includes information regarding descriptions, pricing, availability, and other details.
